            "content": " Thank you, Hon. Temporary Speaker. I rise pursuant to Standing Order 1 for your directions as read with Article 152 of the Constitution on a small but important point. Article 152(3) of the Constitution is very clear that a Cabinet Secretary shall not be a Member of Parliament. I need your direction on the point at which a Member of this House resigns after being nominated to the Cabinet. If that point had been made acute today by Hon. Geoffrey Ruku, he would not have come to the House. However, by coming to the House and letting the whole world see that he is in the House debating his approval, it brings into sharp focus the distinction between Parliament and the Executive. I would like it to be known that this case once arose in respect to another nominee who I understand was a dual citizen. When she was presented with that question, she said she will give up citizenship of the other country. My understanding is a pre-qualification must exist at the time of vetting, at the time of approval, and at the time of appointment and not only at appointment because then it means that at the point of approval, you are not qualified. If you say it is on a promise of subsequently resigning or subsequently relinquishing your citizenship, what happens if you do not? What happens if the President acts on the approval of Parliament without you acting? So, my very small point – and it is not about Hon. Geoffrey Ruku – is seeking guidance for this House and its committees if there is a pre- qualification that is necessary, whether on dual citizenship or holding a certain office. Should it be at the point of vetting or should it be at the point of appointment? I will make my remarks in respect of Ms. Anna Cheptumo when I get the opportunity. However, I associate with the idea that she should just correct what she said. I sympathise with her situation though. I will say that later. Thank you."

            "content": "In his ruling on the Question of when does someone assume office, he said that someone assumes office when he takes oath of office. When you are elected at the constituency, you remain a Member of Parliament elect until you come here to carry the Quran or the Bible to take an oath by swearing or affirming faithfulness to become a Member of Parliament. What is happening now in the case of Hon. Ruku is that the process of being a Cabinet Secretary is ongoing. The President nominates Cabinet Secretaries, forwards their names to the National Assembly for approval then appoints them thereafter. The ceremony of taking oath of office takes place--- Therefore, he is required to resign from the job that he is handling before he takes the oath of office. That is what the Speaker then said. However, yesterday I saw him saying that the NG-CDF is now illegal yet when he was presiding here, he defended the NG-CDF for 10 good years. I am really worried about lawyers. They keep on changing---"
