Temporary Deputy Chairman, I beg to move: THAT, Clause 26 of the Bill be amended in the proposed amendment to Section 8 by— (a) inserting the following new paragraph immediately before the renumbered paragraph (b) — (a) by deleting the words “shall be guilty of an offence and liable to a fine not exceeding five thousand” appearing in the proviso to subsection (1) and substituting therefor the words “commits an offence and shall upon conviction, be liable to a fine not exceeding fifty thousand”. (b) renumbering the existing provision as paragraph (b). We are enhancing the punishment for lawbreakers. The original Act has a maximum fine of Kshs5,000. Through public participation, we agreed that the fine of Kshs5,000 was for a long time ago in the 1980s. Therefore, we are moving to a maximum of Kshs50,000."}
