(1) Subject to the provisions of Part III and Part VI, the Attorney- General shall have power to determine whether a proposed project concerns county government. (2) A contracting authority or county government which intends to enter into a public private partnership shall apply to the Attorney-General for a determination as to whether the proposed project concerns a county government. (3) The Attorney-General shall issue a certificate of the determination in accordance with this section. The intention of this clause is to reinforce what is already in the Bill. Parts 3 and 6 of the Bill categorise Public Private Partnership agreements into those that also concern county governments. I want to give authority to the Attorney-General to have the power to determine whether a project concerns a county government. We have issues with Bills in this House and the Senate between the two Speakers of the two Houses in determining whether a Bill concerns the county governments or not. Therefore, I want clarity. The Attorney-General will determine whether a project concerns the county governments.
