The Commission shall establish offices throughout Kenya.â That is one provision. Regarding the powers and functions of devolved governments, it goes on to say in Article 228:- âExcept as otherwise provided by this Constitution, the powers and functions of the national government and the devolved governments are set out in the Fourth Schedule.â Now, when you go to the Fourth Schedule, this is what is provided for in Article 228(1), page 149:- âGeneral principles of land planning and co-ordination of planning by regions and counties.â Now, the Policy provides a different structure from those that are provided in the current Constitution or, indeed, in the proposed Draft Constitution."}
