(2) Sub-section (1) does not apply to a complaint- (a) that the Commission has declined to entertain under section 36 or dismissed under section 37; (b) that the Minister has referred to the Commission under section 38; or (c) if an application to the Commission by a respondent under section 36 is pending. 3704 PARLIAMENTARY DEBATES November 27, 2008"}
