{"id":210810,"url":"http://info.mzalendo.com/api/v0.1/hansard/entries/210810/?format=json","text_counter":317,"type":"speech","speaker_name":"Mr. Kagwe","speaker_title":"The Minister for Information and Communications","speaker":{"id":229,"legal_name":"Mutahi Kagwe","slug":"mutahi-kagwe"},"content":" Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, the following new clause be inserted immediately after Clause 39 as follows:- Offences 39A (1) A person who:- (a) refuses or fails to comply with the requirement of the Complaints Committee which is applicable to him, to the extent to which he is able to comply with it; or (b) obstructs or hinders the Complaints Committee in the exercise of its powers under this Act; (c) furnishes information or makes a statement to the Complaints Committee which he knows to be false or misleading in any material particular; or (d) when appearing before the Complaints Committee for examination, makes a statement which he knows to be false or misleading in any material particular, commits an offence. (2) A person convicted of an offence under this section shall be liable to a fine not August 2, 2007 PARLIAMENTARY DEBATES 2975 exceeding fifty thousand shillings, or to imprisonment for a term not exceeding three months, or both. (3) Where an offence under this section is a continuing offence, the person convicted shall, in addition to the penalty prescribed in subsection (2), be liable to a fine of one thousand shillings for each day during which the offence continues, or to imprisonment for a term not exceeding three months, or both."}
