Specifically, he stated the following:- (i) the Government of Kenya has fully domesticated the Rome Statute, through the International Crimes Act of 2008; (ii) the Government has facilitated the work of the ICC investigators in Kenya by facilitating collection of evidence through enactment of the International Crimes Procedures for Obtaining Evidence Rules, 2013; (iii) made reference to the appointment of a Judge of the High Court to preside over taking of statements from Government officials; and, (iv) the Government has the capacity and preparedness to investigate and prosecute the three ICC cases, if referred back to Kenya."}
