I beg to move: THAT the Schedule to the Bill be amended in the proposed amendments to the National Hospital Insurance Fund Act No. 9 of 1998− (l) in the proposed amendment to section 30− (iii)in the proposed new subsection (9), by inserting the words “and shall be liable on conviction to a fine not exceeding five hundred thousand shillings” immediately after the word “offence”. The proposed new subsection (9) as contained in the Bill creates an offence without prescribing a penalty. In the absence of a penalty under this new subsection (9), the general penalty in Section 45 of the Act of not exceeding Kshs50,000 will apply. This penalty will be lenient to impose on a health service provider who does not comply with the requirements prescribed by the board. The amendment, therefore, proposes to impose a heavier penalty."}
