If we have to create uniform licensing procedures in the entire country, the county assemblies have no option. It is not their discretion to make laws. The county assembly laws are subordinate to the statute laws by this House and they, therefore, have no option. If the word ‘may’ is retained it will give them a leeway to choose whether they want to legislate or not. If the Constitution commands this House to do something, we do not have an option. Remember that the County Licensing (Uniform Procedures) Bill (Senate Bill No. 9 of 2022) is a uniform licensing Bill for counties by both the Senate and the National Assembly. To put it to effect, there is a need for the county to actualise it by way of legislation. If you leave a lacuna where the counties decide, we will have made a law that amounts to nothing.
