There have been court decisions, some of which seem to say that the selection panel in existence now may be in breach of the Constitution. That may expose them to some form of personal liability. But for as long as we know for sure the reasons why they never worked as they should, then that should remain. It is true that there is a selection panel and the commission has vacancies, but we did not have a way of nominating bodies under the Act, being required to submit names of their nominees within given periods of time. This is why we have given them 14 days to do it because it has to be competitive. There may be need for advertisements. We realised, even within the National Dialogue Committee (NADCO), that if you give nominating bodies seven days and also expect them to have some due process in deciding on the nominees that they will present, they will not have enough time. We, therefore, proposed to have 14 days and we agree with the Committee. This will ensure that within the 14 days, at least, each of the nominating bodies, from the Parliamentary Service Commission, the Inter- Religious Council of Kenya, Political Parties Liaison Committee (PPLC) and the Law Society of Kenya (LSK), will have some time to advertise and notify their members to have some due process.
