Members, before the House proceeds to the next Order, which is the consideration of the Social Protection Bill, (National Assembly Bill No.12 of 2025), and the Value Added Tax (Amendment) Bill, (National Assembly Bill No.11 of 2025), in the Committee of the whole House, I wish to provide guidance with respect to the consideration of some of the amendments that have been proposed by individual Members. As you are aware, it is now established practice under the Constitution that when we are considering any matter that has a financial implication, the House is bound by the provisions of Article 114(2) of the Constitution. For clarity, Article 114(2) of the Constitution provides that: “If, in the opinion of the Speaker of the National Assembly, a motion makes provision for a matter listed in the definition of “a money Bill,” the Assembly may proceed only in accordance with the recommendation of the relevant Committee of the Assembly, after taking into account the views of the Cabinet Secretary responsible for finance”. In this regard, you will notice that in today’s Order Paper, the Member for Funyula, Hon. (Dr) Ojiambo Oundo, has proposed amendments to the Social Protection Bill, 2025. He is proposing to amend Clauses 2 and 31 and introduce new Clauses 30A and 30B to the Bill, all relating to the establishment, functions and membership of Social Protection Committees in each sub-county. I have analysed his amendments and noted that they contain proposals touching on matters listed in the definition of a money Bill, pursuant to the provisions of Article 114(2) of the Constitution. This means that such proposal may only be proceeded with if there is concurrence of the National Treasury, through the Departmental Committee on Social Protection. In the absence of evidence that the amendments were processed in the manner contemplated in Article 114 of the Constitution, the Speaker is left with no choice but to direct that the Committee of the whole House shall not consider any of the amendments or parts of the amendments that have been published in the Order Paper without a disclaimer. The Committee of the whole House on the Social Protection Bill, 2025 will, therefore, proceed without reference to the proposed amendments by Hon. Oundo and will be considered as though the amendments have been withdrawn. The House is accordingly guided. Hon.
