Kimani Ichung’wah","speaker":null,"content":"THAT, Clause 17 of the Bill be amended- 1) in paragraph (a) by deleting the words “public officers” and substituting therefor the words “any person”, 2) in paragraph (b) by deleting the words “public officers” and substituting therefor the words “any person”, 3) by deleting paragraph (c). The reservations relate to reporting authorities maintaining a register of gifts received. We had said gifts received by public officers serving in the reporting entity. The President's Reservations have added the word, ‘any person’, that it is gifts received by any person serving in the reporting entity not just public officers. It exactly says that a register will be maintained of all persons that receive gifts including when a judge comes to visit my court and sometimes they come with their mothers, because sometimes it is nice to carry an old lady to show her the rest of the country, and I gift her a chicken. If the judge forgets to declare that chicken, they would have committed an offence and will be liable to prosecution. It is not only the judge, but any public officer who fails to make the declaration.
