My learned junior from Githunguri Constituency asked me about compliance and I did say, and I think perhaps he was consulting with my other learned junior, Mrs. Odhiambo-Mabona. I said that this is a judgment incapable of obedience. I did not say we will not respect the court order. That is standard language that any good lawyer who goes on appeal uses in indicting a judgment. And any good lawyer like Olago Oluoch here will tell you that a judgment incapable of obedience is not an assault on the Judiciary. It never will be! As to whether the Executive was negligent in handling this matter or not – and this comes to the point raised by Mr. C. Kilonzo – Mr. Deputy Speaker, Sir, the Attorney-General has indicated that he is not satisfied in the manner that the case was handled in the first place. He has filed an appeal and I have no doubt that he has a good chance on the law, because the law is very clear on this matter. Mr. Deputy Speaker, Sir, hon.
