Members, however, I claim that Section 10 of the PSC Act, 2019 does not seem to prescribe any process which a member of the public may take to initiate removal of a member of the Commission for any of the stated reasons. Indeed, this procedure is similar to the one for the removal of a Cabinet Secretary (CS). Article 152(6) of the Constitution provides that a Member of the National Assembly may propose a Motion for removal of a CS. However, Article 152 of the Constitution, just like Section 10 of the PSC Act, 2019, does not provide for the procedure for removal of a CS by instigation of any other person other than a Member of the National Assembly. This, therefore, implies that in the case of the PSC, just like in the case of a CS, no other person can initiate the process for removal of a commissioner other than a Member of Parliament."
