Chairman, I beg to move: THAT, Clause 4 of the Bill be amended in sub-clause (2) by deleting paragraph (b) and substituting therefor the following new paragraph— “(b) the written consent of the owner of the site or any other person with an interest in the site entitled to give consent.” The essence of this amendment is to ensure that county governments are able to carry out this mandate as provided for in Article 186 and the Fourth Schedule of the Constitution. There was a proposal that one should get consent from Kenya National Highways Authority (KeNHA). Basically, this is a county government function. Without the KeNHA consent, it means a licence cannot be issued. Clause 7 of the Bill already provides for consultations among various entities."
