"content": "(Prof. Saitoti): Madam Temporary Deputy Speaker, I do not in anyway accept the allegation by hon. Kiema Kilonzo that the Government is targeting only the No Group. I think all the hon. Members will agree that the people who have made these utterances, or the statements are being dealt with by the law enforcement officers as individuals absolutely because in court, you go by yourself. Therefore, whether you are in the Yes or No and you spread messages of hate to create problems, you will be dealt with. So, there is no discrimination whatsoever. I know that my good friend, hon. K. Kilonzo, also wanted the Government again to reign in on the media. I think we have come a long way. We have travelled a very long way from the time that there was restriction of the media. I do not think we want to do that. But, of course, I have also made an appeal to the media owners and all the others. Let us also know that they themselves live in this country and they can actually be able to put into place mechanisms for self-control to ensure that what is being reported is not intended to destroy the country. I do not think on this incident, we should really regress on what you all know you worked very hard to achieve; the freedom of the media. Hon. Imanyara made a very good observation where he actually wanted to get clarification on the details of the licence. Normally, as hon. Karua has said, when a decision was taken by this Parliament to really basically free the Government from controlling the holding of the rallies, it was agreed that those who would want to convene the rallies of any kind would only need to notify the police. They will be allowed and the intention clearly was to ensure that the police or security will be on guard to ensure things went on very well. On this particular case, the information that I have is that, indeed, the rally went on up to the permitted time. There was no incident. This incident only took place after all the speeches and other things including prayers had been done. It was only at the time of the closing prayers that the explosion took place. Of course, that tells you about a lot of things and we are looking into all that. But having said this, let me put it this way: What are we doing for the future? Since the rallies will continue, I do not think we should be intimidated, that because this thing has happened, then we call off the rallies or worse still anything to do with the constitutional process. We cannot succumb to that blackmail. I have said that we are going to beef up security, the surveillance and intelligence gathering before and during the time when the rallies are being held and thereafter. We will also definitely look at the various conditions that are set up to see whether there may have been an omission of a condition that had we put in, it could have, perhaps, averted this scenario. Madam Temporary Deputy Speaker, there is that issue about the insertion of some words in the draft Constitution at the time of its printing. I think hon. Members are aware that when such an insertion was discovered, the Attorney-General moved very quickly and ensured that, indeed, the draft which was proper was the one which was released to the people. An investigation from that time was instituted by the Commissioner of Police. That investigation is still on, but we have insisted that a speedy report should be made to us. But it is to be understood that, yes, that one was done in a very awkward way, and that awkwardness, of course, raises some kind of worry about it and we will make sure that we look into it. Madam Temporary Deputy Speaker, I think I have ordered the plans for the future, and I have said that we will make sure that the thing will be done properly and, indeed, I think that answers what hon. Mungatana has raised. We are going to be much more vigilant on this."
