"content": "Mr. Speaker, Sir, the Committee met with the petitioners on Thursday, 17th September 2020 and on Thursday, 24th September 2020, we met with the County Government of Nandi led by the Governor and the County Public Service Board. The Petitioners were also present in this meeting. Mr. Speaker, Sir, the Committee made the following observations: - (1) THAT, the petitioners, Ms. Judith Chepchumba, Mr. Mark Kirwa and Ms. Nelly Chepngetich were indeed recruited and appointed on 1st November 2019 for positions of Support staff II Job Group “B” And Cleaner II Job Group “B” and allege that they have not been compensated for the work done for eight months. However, after the petitioners brought the matter to the Senate, they went to court to seek redress. (2) THAT, the same petitioners sought recourse in the court having filed their claim in court on the 3rd of August 2020; resulting in a notice of summons to the County Government of Nandi on 5th August 2020 and a further statement of claim filed in Kapsabet at the Employment and Labour Relations Court. No. 51 of 2020; (3) THAT, the case is active in court with a defense having been filed stating the position of the county with the county government of Nandi awaiting direction of the court; (4) THAT, the same petition bearing similar subject matter was presented before the Senate on 8th August, 2020, by the same petitioners; (5) Taking into consideration the observations, the Committee notes that under Standing Order 98 on the Sub Judice rule, various rulings by the Speaker on the same and the precedent set on the 2nd August 2018 by the Speaker of the Senate on the Solai Dam that even if elements of active proceedings, prejudice have been met, the Speaker still has the discretion to decide whether a matter should proceed or not to the following reasons: - a) If it is a matter of great public interest; and b) If it is a matter about human rights.
