Members, in the Supplementary Memorandum, His Excellency the President recommends that Clause 8 of the Bill be amended in Subclause (b) by inserting the words “subject to the Constitution” immediately after the word “shall”. The House will, therefore, be required to reconsider Clause 8 of the Bill in accordance with Section 46(5) of the Constitution and approve the recommendation proposed by the President with or without amendments, or refuse to accept the recommendation and approve the Bill in its original form by a resolution supported by votes of not less than 65 per cent of all Members of the National Assembly, excluding the ex-officio Members. Hon. Members, 65 per cent of 222 translates to 144.3 Members, which is rounded upwards to 145 Members since the words used are “not less than 65 per cent of all Members of the National Assembly, excluding the ex-officio Members.” On the reporting procedure, the Bill will not be read a Third Time as this was actually done and the Bill passed on 9th December, 2009.
