"content": "Hon. Members, Standing Order No.225(2)(b) requires the Speaker to report to the House any petition other than those presented through a Member. I, therefore, wish to convey to the House that my Office has received a Petition regarding the removal of Ms. Tabitha Mutemi as a member of the Media Council of Kenya (MCK). The Petition is signed by Muriuki Muriungi, Advocate, on behalf of KMK Africa Law Advocates of P.O Box 51957-00100 Nairobi, stating that Ms. Tabitha Mutemi has acted in gross misconduct and in breach of the Constitution and several other laws of the Republic by holding two public offices. The Petitioner contends that Ms. Mutemi has, inter alia, violated the following provisions of the Constitution and written law: 1. Article 77(1) of the Constitution, which restricts fulltime State officers from participating in any other gainful employment, by knowingly serving as a member of the Media Council of Kenya, while at the same time being a fulltime employee of the Independent Electoral and Boundaries Commission (IEBC), as the Manager for Corporate Communications; 2. Article 201(d) of the Constitution regarding prudent and responsible use of public funds by allegedly drawing emoluments, both as a member of the MCK and an employee of the IEBC, amounting to wastage of public funds; 3. Section 2(1)(b) of the Fourth Schedule to the IEBC Act, which provides that members and staff of the Commission shall not, during the tenure of office, be eligible for appointment to another public office, by knowingly taking up appointment as a member of the MCK Board, while on fulltime employment at the IEBC; and, 4. Section 26(2) of the Leadership and Integrity Act, which restricts fulltime State officers from participating in any other gainful employment.
