"content": "Mr. Speaker, Sir, the position about constitutional amendment is old. Once a Bill is introduced, it cannot be amended. The question of public participation is not for purposes of amending. It is out of abundant caution following Article 10. I am not certain because none of the Speakers has communicated to any Floor and I am not aware that they have said when, for instance, in the case of Makueni, the executive conducted its public participation and the assembly conducted its public participation. However, in reporting to the Senate, and the National Assembly, did they forward what Makueni raised and said? The Speaker has not said that through his communication. This, therefore, suggests that that part of public participation ended there. It was a view of many people who did not have constitutional challenges that the portion where Parliament is supposed to consult and listen to public views must be complied with. If you doubt, there is a very famous South African case about public participation. It is out of abundant caution.
