"content": "Madam Deputy Speaker, if you remember, I was talking about the foundational values: That the only recourse that we have, and there are certain cases in India that when you amend and you are moving out from the basic structure of the Constitution, then the courts can stop you. However, we do not have similar jurisdiction and jurisprudence in Kenya. I must say that whereas I sympathise with Sen. Wetangula, but you will find that in many those parts of the Report, the experts were saying if you amend this provision, it will be unconstitutional because if the provisions remain the way they are without amending certain provisions, then they will be unconstitutional. That is why they were saying with regard to the Schedule, that because we have not amended certain sections of Article 89, then it will be unconstitutional or it will not be properly anchored."
