"content": "Finally, I have an issue with Clause 41 of the Constitution of Kenya (Amendment) Bill, 2020, which seeks to amend Article 168 of the Constitution to make provisions on removal of a judge from office. It allows Judiciary Ombudsman to initiate a Motion to remove a judge from office on account of complaints received from the people. This provision is archaic and unconstitutional. It is against the tenets and principles of natural justice, that is, the right to fair hearing and right to be heard. I further submit that Article 10 of the Constitution, as far as the Judiciary and its independence is concerned, falls under the eternity clause which by practice is un-amendable."
