    "content": "The discussion on the basic structure of the Constitution leads us to the question of whether the Bill contains unconstitutional constitutional amendments. As you are aware, Article 3 of the Constitution (Defence of the Constitution) and Article 10 of the Constitution (National Values and Principles of Governance) place an abiding obligation on the Speaker to respect, uphold and defend the Constitution. As an extension of this constitutional imperative, Standing Order 47 (3) of the National Assembly Standing Orders requires the Speaker to, among other considerations, assess the constitutionality or otherwise of business proposed for introduction to the House. Standing Order No.47 (3) provides: “(3) If the Speaker is of the opinion that any proposed Motion: (a) is one which infringes, or the debate on which is likely to infringe, any of these Standing Orders; and, (b) is contrary to the Constitution or an Act of Parliament without expressly proposing an appropriate amendment to the Constitution or to the Act of Parliament; (c) ………. ; (d) ……….. ; (e) ……….. ; or (f) ………… ; The electronic version of the Official Hansard Report is for information purposesonly.
