"content": "Mr. Speaker, Sir, I beg to move:- THAT pursuant to the provisions of section 33(4) of the Constitution of Kenya Review Act, 2008, this House approves the Draft Constitution submitted by the Committee of Experts and laid on the table of the House on Tuesday, 2nd March, 2010 subject to the amendment of Article 31 by deleting paragraphs (a) and (b). Mr. Speaker, Sir, in the proposed Draft Constitution, Article 36 (a) refers to the right of a person not to have--- It reads as follows:- âEvery person has the right to privacy, which includes the right not to have (a) their person or home or property searchedâ; and, âbâ âtheir possessions seizedâ. Mr. Speaker, Sir, I am informed by the fact that we want to enact this Constitution and, in particular, Clause 31 (b) to say that the âpossessions shall not be seized---â I am going by the definition of the word âpossessionâ, which includes wealth and property. We have so many people who have used their property as collateral in banks and in other institutions to get loans. If, therefore, we enact this as it is, I am persuaded that, then, people will get a blank cheque to have their loans written off."
