"content": "If you look at Clause 2, it states that in nominating or appointing a person as a member of the board, the governor shall observe the principle of gender equity, ethnic and other diversities of the people of Kenya. Providing for gender equity and ethnic diversities of the people of Kenya is a good provision which is constitutional. However, I am just wondering how practical it might be. Most of our counties are employing people from the same county, which is a factor that is recognised in the National Cohesion and Integration Act - which is the next Bill that is coming up for overhaul. So, I do not know whether that will change the legislative framework but, if it does not, then it is one of the areas where that constitutional provision is allowed. They may not provide totally for the ethnic inclusion that we seek."
