"content": "Mr. Speaker, Sir, the next report is of Msambweni Village in Voi Sub-County of Taita Taveta County regarding the alleged impending eviction of Msambweni residents by a private company. We went to Msambweni and we listened to the petitioners. This land belonged to Bata Shoe Company and Bata Shoe Company also sold it. The conditions under which Bata Shoe Company got this plot was that they were going to build a Bata factory at that site. Bata Shoe Company never built the shoe factory but they instead sold the land to other people. As I talk, this case is in court. The Committee conducted investigations and did a site visit on 27th March, 2021. The Committee recommends that the DCI and the EACC investigate the circumstances leading to failure of adherence to the conditions of the grant of the Msambweni land to Bata Shoe Company Limited and issuing a consent to the transfer of the land to Sparkle Properties Limited. The Committee further recommends that the Cabinet Secretary, Ministry of Lands and Physical Planning and the Cabinet Secretary, Ministry of Interior and Co-ordination of National Government ensure that the residents of Msambweni are not evicted from the Msambweni land until the investigations are completed. The National Land Commission should ensure that no funds for compensation for compulsory acquisition are released to Sparkle Properties Limited until conclusion of the investigations. Mr. Speaker, Sir, this is a tricky case where Bata Shoe Company has been given conditions before the land was allocated to them and one of the recommendations was that they should built a Bata Shoe Company, but not sell the land. Now Bata Shoe Company found it prudent to sell the land to Sparkle Limited and they did not seek permission from those who owned the property. So, we are expecting that the recommendations of this Committee will be followed and implemented by the Government departments which are supposed to do so. I had already tabled the reports. All of them are with the Clerk of the Senate. I have only two other ones to present. Mr. Speaker, Sir, the next one is a petition concerning the adverse effects of rock blasting at Thwake Dam. I do not wish to present this one because there is still one or two recommendations that we are making later and this report can be presented by next week. As you have heard, the Committee of Lands, Environment and Natural Resources has a lot of work and responsibility. I would beg that this Committee be given a little more funds to be able to move to all corners of this country to investigate cases pertaining to land issues."
