Members, the Petitioners are convinced that employing a person with a past criminal record can demonstrate diversity, inclusion, social responsibility and act as an avenue for their rehabilitation, thereby reducing the likelihood of them relapsing back to crime. In addition, they said that the portray of court case details on the police clearance certificates amount to discrimination on grounds of conscience since it reminds the job seeker of their past. In this regard, they provide reference to the United States of America (USA) State of Indiana as well as the United Kingdom (UK), as examples of jurisdictions where certain misdemeanours and non-violence felonies are expunged from the offender’s record after several years."
