The words read “where the office of any member becomes vacant, whether by death or otherwise, the Chief Justice may appoint…” It is not compulsory that the Chief Justice appoints. Does it mean that the Committee contemplated a situation where the Tribunal can sit despite a vacancy, in spite of there being a vacancy? Would it have been fair enough to state “the Chief The electronic version of the Official Hansard Report is for information purposesonly. A certified version of this Report can be obtained from the Hansard Editor."
