Temporary Deputy Speaker, it is the constitutional duty of every government to protect its citizens by providing a level playing field for all of them regardless of their social status in the society. It is also a constitutional obligation of every government to see to it that there is equal and even administration of justice through the various government justice apparatus. The Kenya National Examinations Council Act 2012 provides that the function of the Council shall be to award certificates or diplomas to candidates in such institutions, and such certificates and diplomas shall not be withheld from candidates by any person or institution. Further, in July 2014, the Government of Kenya, through the then Cabinet Secretary for Education, issued an order vide a circular compelling all secondary school head teachers to release all KCSE certificates withheld illegally for various reasons to the respective candidates.
