"content": " Thank you, Hon. Speaker. I beg to move that The Kenya National Commission on Human Rights (Amendment) Bill, National Assembly Bill No. 1 of 2020, be read a Second Time. The main objective of the Bill is to amend the Kenya National Commission on Human Rights (KNCHR) Act No.14 of 2011 in order to merge the KNCHR and the National Gender and Equality Commission (NGEC) in order to retain the Kenya National Human Rights and Equality Commission (KNHREC) as established under Article 59(1) of the Constitution. Article 59(1) of the Constitution establishes the KNHREC, while Article 59(4) gives Parliament the responsibility of enacting legislation to give full effect to the Constitution with regards to the protection of human rights, including legislation on restructuring of the Commission into two or more separate commissions. Parliament in 2011 established three commissions, namely, the KNHRC, the NGEC and the Commission on Administrative of Justice instead of establishing one commission, the KNHREC, as envisaged under Article 59(1). Article 59(4), which gives Parliament authority to enact legislation to restructure the commission into two or more separate commissions, envisaged that the KNHREC should have been established first. Hon.
