"content": "Part VII of the Bill provides for the disciplinary process for any professional misconduct. This will be undertaken by the disciplinary committee that will be established under Clause 32. The Bill delegates legislative powers, but does not limit any fundamental rights and freedoms. The delegated power is on the development of guidelines and regulations by the Cabinet Secretary responsible for matters relating to insurance in consultation with stakeholders, for the better carrying out of the provisions of the Act. The Bill does not concern county governments in terms of Article 110(1)(a) of the Constitution, as it does not affect the functions and powers of county governments as set out in the Fourth Schedule of the Constitution. Monetary policy, including insurance, is a function of the national Government under Paragraph 10 of the Fourth Schedule of the Constitution. However, the Bill is a money Bill within the provisions of Article 114 of the Constitution, as its enactment may occasion additional expenditure of public funds to be provided through the annual estimates, which is necessary."
