Temporary Deputy Speaker, I beg to move the following Motion: THAT, this House adopts the Report of the Committee on Delegated Legislation on its consideration of five sets of Draft Election-Related Regulations, laid on the Table of the House on Thursday, 2nd June 2022, and pursuant to the provisions of Section 109(3) of the Elections Act, 2011 resolves to REJECT the following- (i) the Draft Elections (Registration of Voters) (Amendment) Regulations, 2022; (ii) the Draft Elections (General) (Amendment) Regulations, 2022; (iii) the Draft Elections (Voter Education) (Amendment) Regulations, 2022; (iv) the Draft Elections (Party Nominations and Party Lists) (Amendment) Regulations, 2022; and, (v) the Draft Elections (Technology) (Amendment) Regulations, 2022. The Chairman of the Independent Electoral and Boundaries Commission (IEBC) forwarded a letter dated 7th April 2022, to the Clerk of the National Assembly, submitting the Regulations as read above. The Draft Regulations were received on 11th April 2022 at the Speaker’s office and tabled on 14th April 2022, being the last day preceding the long recess which ran from Friday, 15th April 2022 to Monday, 9th May 2022. They were subsequently committed to this Committee on Delegated Legislation. Section 109 (1) of the Elections Act (No. 24 of 2011) confers on the commission powers to make Regulations for the better carrying out of the purposes and provisions of the Act. Section 109(3) of the Elections Act provides that the power to make Regulations shall be exercised only after a draft of the proposed Regulations has been approved by the National Assembly, at least, The electronic version of the Official Hansard Report is for information purposesonly.
