Nthumbi further states that the Commissioners grossly misconducted themselves by: 1. concurring to support the unlawful attempt to alter the results of the presidential election in favour of one candidate or in the alternative to force a run-off; 2. acting in liaison with one faction in the presidential election; 3. refusing to follow the well set out guidelines for the verification, tallying and announcement of the presidential election; and, 4. swearing affidavits in support of petitions challenging the presidential election."
