The burden on who must prove that this matter is active in court is on the Senator invoking the rule on sub judice . If a may read to you, Standing Order No.103 (4) reads: “A Senator alleging that a matter is sub judice shall provide evidence to show that paragraphs (2) and (3) are applicable.” The word used is “shall”."
