Deputy Speaker, I beg to move the following Motion: THAT, this House adopts the Report of the Public Accounts Committee on the appointment of a firm to provide external audit services to the Office of the Auditor-General with respect to the accounts of the Office of the Auditor-General and the financial statements for mortgage and car loan scheme of the Office of the Auditor- General, laid on the Table of the House on Thursday, 20th April 2023 and, pursuant to the provisions of Article 226(4) of the Constitution and Section 43 of the Public Audit Act, 2015, appoints M/s PKF Kenya LLP for purposes of providing external audit services to the Office of the Auditor-General with respect to — (i) the accounts of the Office of the Auditor-General for the period 2020/2021 Financial Year and 2021/2022 Financial Year; and, (ii) the financial statements for the staff mortgage and car loan scheme of the Office of the Auditor-General for 2017/2018, 2018/2019, 2019/2020, 2020/2021 and 2021/2022 financial years. The people of Kenya, through Constitution 2010, decided to make a provision under Article 226 requiring that Parliament appoints an auditor to audit the Auditor-General. I am talking about an auditor to audit the Office of the Auditor-General because the Auditor-General has the mandate to audit all Government ministries, departments and State agencies, including State investments. But who audits the Auditor-General? It should be an auditor appointed by the institution that oversees the Office of the Auditor-General, which is Parliament. Very quickly, Members may be interested in finding out how we arrived at PKF Kenya LLP as the auditor to audit the Office of the Auditor-General for 2020/2021 and 2021/2022 financial years, together with the special audits of the staff mortgage and car loan schemes, which have not been audited since 2017 to date. Parliament’s procurement system put up an advertisement in the local dailies as required by law, inviting audit firms which are interested in auditing the Office of the Auditor- General to forward their bids. This advertisement was in the Daily Nation and The Standard newspapers of 16th February 2023. The tender submission and opening date were scheduled for 28th February 2023 at 11.00 a.m. The tender document required interested parties to submit separate technical and financial bids for evaluation. On 23rd February, a tender committee was appointed by the Accounting Officer, who is the Clerk of the National Assembly of the Republic of Kenya, pursuant to Section 78 of the Public Procurement and Asset Disposal Act, 2015, to oversee the tender-opening process."
