"content": "Mr. Temporary Deputy Speaker, Sir, I appreciate that very much and the House certainly does. Let us look at the Presidentâs authority under the Constitution. Indeed, Section 23 of our Constitution vests the Executive authority of the Government in the President. The Executive authority of the Government of Kenya shall vest in the President and, subject to this Constitution may be exercised by him either directly or through officers subordinate to him. Subsection (2) says: âNothing in this section shall prevent Parliament from conferring functions on persons or authorities other than the President.â Even though Section 23, vests Executive authority in the President, its Subsection (2) allows this House to delegate that power to any other authority or person. When you look at the Kenya Anti-Corruption and Economic Crimes Act, Section 8(3) says that the authority to hire and fire a director is delegated to the KACC Advisory Board, working together with parliament and the President only exercising the ceremonial role of appointing."
