    "content": "I have always known that “gender” is reference to either male or female. We probably need to come back to that issue in future. “Marginalised community” is defined as a community that, because of its relatively small population or for any other reason, has been unable to fully participate in the integrated social and economic life of Kenya as a whole. Earlier on, I indicated that 35 communities form 8 per cent of the population of Kenya. These are what I call “marginalised communities.” How do you signify a marginalised community? This is a traditional community that out of need or desire to preserve its unique culture and identity from assimilation, has remained outside the integrated social and economic life of Kenya as a whole. An indigenous community is one that has retained and maintained a traditional lifestyle and livelihood based on a hunter or gatherer community, or pastoralist persons or communities whether they are nomadic or settled communities. Because of its relative geographic isolation, it has experienced only migration marginal participation in the integrated social and economic life of Kenya as a whole. “A marginalised group” then as defined in Article 260 of the Constitution of Kenya, is a group of people who, because of laws or practices before or after the effective date of the Constitution of Kenya 2010, were or are disadvantaged by discrimination on one or more of the grounds in Article 27(4) of the Constitution. What do we do with such situation? We have to ensure proportionate representation, which refers to representation of such communities in the Public Service relative to the national population size. Proportionate representation ignores the persons who fall in the category of the 8.24 per cent of the population of Kenya, and that is where the challenge is in terms of the Legislature working on it through the reports. That is why the reports are very important. “Race” refers to the groups of people who have differences and similarities in the biological traits deemed by society to be socially significant. “Sex” is what I was talking about; gender. It is the biological orientation of being male or female. That is in the Constitution. The bi-sexual or no sex alternative is not in the Constitution at all. We should not think or even contemplate about it. Hon. Temporary Speaker, we know the definition of “youth” as the collective of all individuals in the Republic of Kenya who have attained the age of 18 but have not yet attained the age of 35. Today many people still count themselves as youth yet they do not qualify as such as per the Constitution. A youth, after the age of 35, is no longer one.
