The Children Act, 2022, Section 144 (e) states that a child whose parent or guardian has been detained, held in custody or imprisoned or is in remand, is a child in need of care and protection. The Kenya Prisons Service, in collaboration with the Ministry of Labour and Social Protection and other partners, developed a Policy on Care of Children of Incarcerated Mothers (2022), to offer guidance to all stakeholders in quality care for children of incarcerated mothers aged zero to four years. The policy highlights the importance of early childhood development, with focus on children of incarcerated mothers aged zero to four years born in prison or accompanying their mothers to prison. The policy provisions are in the following areas: living space, health, nutrition, early learning and play, psycho-social support, safety and security, and responsive care giving and reintegration processes"
