Lack of regulations to enforce adjustment orders as provided for in Section 24 (2) of the Persons with Disabilities Act 2003 that are issued after an accessibility and usability audit has been conducted. 3. Government Ministries, Departments and Agencies fail to budget for the implementation of adjustments recommended through Accessibility and Usability Audits. 4. Weak legal framework for the enforcement of provisions related to improving accessibility for persons with disabilities. To accelerate improvement of accessibility for persons with disabilities, the National Council for Persons with Disabilities recommends the following: 1. That the Building Code is amended to comply with KS 21542 Building Construction - Accessibility and Usability of the Built Environment developed by the Kenya Bureau of Standards (KEBS) to ensure all building plans approved by various Physical Planning Departments across the country are compliant at the design stage. 2. Strengthen the capacity of Ministries, Departments and Agencies to mainstream disability through training of the committees responsible for spearheading disability mainstreaming, staff and senior management to enable them to integrate disability inclusion concerns into the delivery of the institution’s mandate. 3. Finalise the National Disability Policy to provide all public, private and development organisations with a national blueprint towards a more inclusive Kenyan society. This policy has been in draft for some time now. 4. Enact the Persons with Disability Bill, 2023 into law to provide a more robust legal framework to enforce the provisions of the law related to improving accessibility for persons with disabilities."
