Question number one that has been proposed by the litigants is: Whether Section 8 and the First Schedule of the Anti-Corruption and Economic Crimes Act are consistent with Section 24 of the Constitution. The second question posed by those litigants is: Whether under Section 24 of the Constitution, Parliament can lawfully delimit the President’s power to constitute and abolish offices for the Republic of Kenya, of making appointments to any such office and terminating any such appointments as has been legally exercised by Parliament to protect the independence of the Kenya Anti-Corruption Commission (KACC) and its Director under Section 10 of the Anti-Corruption and Economic Crimes Act, 2003."
