Question number 11 is whether the President’s unilateral re-appointment of the Director and two Assistant Directors of KACC undermines the rule of law and subverts constitutional democracy in Kenya. Question number 12 is whether the National Accord and Reconciliation Act, 2008, and the Constitution of Kenya (Amendment) Act, 2008 have any bearing or import on the exercise of the President’s power under Section 24 of the Constitution."
