There is no reference in Section 3(2) for the President to be advised either by Parliament or by the advisory body on the reappointment of Justice Ringera. Mr. Speaker, Sir, even if the Assistant Directors came through Parliament, it was not necessary. The President âmayâ. He has discretion. He has exercised his discretion in this case by appointing Justice Ringera without reference to the Advisory Board or Parliament because the law allows him to do so. So, the question is: Since the President has acted properly and in accordance with his powers and within the four corners of this law, what are we referring to that Committee on Subsidiary or Delegated Legislation? That is number one. Secondly, the President has exercised his powers, not under a subsidiary legislation, but under Section 3(2) of the Act. The Schedule is not a subsidiary legislation. So, it will be wrong in precedence to refer this matter to the Committee on Delegated Legislation."
