Temporary Chairman, I beg to move: THAT, Clause 52 of the Bill be amended— (a) by deleting sub-clause (2) and inserting therefor the following new sub-clauses— “(2) A data controller, who being a custodian of, and who transfers outside Kenya, biological specimens, health images, human tissues and organs of a Kenyan citizen shall ensure confidentiality of personal health information: Provided that where such transfer is for purposes of health research or post-mortem, the Data controller shall— (a) provide a report to the Director-General for Health stating the findings; (b) not share the health information without notifying the Cabinet Secretary; and (c) seek guidance from the Cabinet Secretary in the manner the health information shall be stored, processed and destroyed.” The electronic version of the Official Hansard Report is for information purposesonly.
