Temporary Chairlady, I beg to move: THAT, Clause 10 of the Bill be amended in sub-clause (1) by deleting the words “or reasonably ought to know” appearing immediately after the word “knows”. The justification is that we have to clarify the state of mind applicable to the offense of conflict of interest in decision-making. It is first-hand knowledge by a public officer that a decision will place them in a position of conflict of interest. The deletion avoids speculative victimisation of public officers where we are not sure what they have done."
