Members, the petitioners indicate that the Petition was before the National Assembly’s Departmental Committee on Lands in 2018, which recommended that the National Land Commission (NLC) would determine the historical land injustice case number NLC/HLI/025/2017 lodged by the petitioners within three months. The NLC recommended that the Chief Registrar of Lands would revert the land to the claimants and in the alternative, the family of the private developer was to provide an alternative land to the squatters. The petitioners indicate that the family of the private developer moved to the High Court to challenge the NLC’s determination in case number ELC/JR/5/2019. Further, Kiambogo Ontulili Farmers and Mt. Kenya Squatters Group applied to be enjoined in the case that was consolidated on 7th July 2021 and the court directed that the matter be referred back to the NLC for reconsideration."
