I second the Report of the Select Committee on Delegated Legislation as regards the Prevention of Terrorism Act (Implementation of the United Nations Security Council Resolutions on the Suppression of Terrorism) Regulations, 2023. Terrorism is a worldwide problem. That is the reason why the United Nations came up with the Convention on Prevention and Suppression of Terrorism, which Kenya is a signatory to. The Convention requires that the domesticating county must also have a domestic law that deals with anti-terrorism. Kenya has the Prevention of Terrorism Act, which is the parent Act of the Prevention of Terrorism Act (POTA) Regulations, as they will popularly be known. Having gone through the Report of the Select Committee on Delegated Legislation, I am persuaded that the Report conforms to the requirements of the Statutory Instruments Act, which is the parent law when making subsidiary or delegated legislation. As properly enunciated by the Chairperson, the Committee appears to have considered all facets and requirements under that Act, and these Regulations satisfy those requirements. Most important is public participation, where Kenyans were supposed to give their positions as regards the Regulations. Once that condition is met, the policy background, the statutory timelines, and the need for a Regulatory Impact Statement are checked, then the Committee recommends approval of those Regulations. It is important to note that the Regulatory Impact Statement is an exemption, and once enforced, there is no obligation or requirement for the regulatory-making authority to prepare that statement. With those remarks, I urge the House to adopt that Report and the Regulations. I beg to second."
