Temporary Speaker, for giving me an opportunity to contribute to this very important piece of legislation; the Natural Resources (Benefit Sharing) Bill, (Senate Bill No. 6 of 2022). I listened to the Chair of the Departmental Committee on Environment, Forestry and Mining. The Committee’s recommendation is to reject this Bill. I shall not agree with the position of the Committee for the following reasons. One of the issues that has been raised by the Committee for rejecting this Bill is that a money Bill cannot originate from the Senate. I have read Article 109(5) of the Constitution. It provides that: “A Bill may be introduced by any member or committee of the relevant House of Parliament, but a money Bill may be introduced only in the National Assembly in accordance with Article 114.” Having read that provision of the Constitution and several court decisions on that matter, the Constitution uses the word “may” and not “shall.” That means it is not mandatory.
