Regarding whether the Deputy Governor conducted himself properly in accordance to Article 76 of the Constitution, our answer is that he conducted himself properly. First of all, we are not making an admission that this money was meant to make an influence because it was a mere refund. It is our position that borrowing between friends is not prohibited by Article 76 of the Constitution of Kenya. It is our position also that if it were to have been the case that it was meant to be a bribe, that is when you can invoke Article 76 of the Constitution. Our position is that it was not a bribe. It was a friendly loan between the two of them. It was a refund that was made on 28th May, 2023."
