Conflict of interest is addressed under section 16 of the Leadership and Integrity Act and it clearly states that - “A state officer or a public officer shall use the best efforts to avoid being in a situation where personal interests conflict or appear to conflict with the state officer's or public officer's official duties.” Now, when we talk of personal interests, we look at Section 16(6), which explains or rather indicates that- “personal interest” includes interest of spouse, child, business associates, agents, or any other matter in which the state officer or public officer has a direct or indirect pecuniary or non-pecuniary interest.” Basically, in practice, what happens is we also have the regulation, which is the subsidiary law of that particular Act. If you look at the conflict of interest, that particular part three of the Leadership and Integrity Regulations clearly specifies how conflict of interests are supposed to be dealt with by public officers."
