    "content": "three previous drug- trafficking convictions and had been given a final warning prior to the last offence that led to his dismissal. As pertains to the ex-warder’s subsequent appeal, grounded on the basis that he was not accorded an opportunity to be heard, I find the same to be unfounded. The Departmental Disciplinary Board proceedings that determined his dismissal attest to the fact that he fully participated in the said proceedings and, indeed, gave his statement. He was further accorded the chance to cross-examine the witnesses, which he did exhaustively. He produced no defence witnesses despite being availed with the chance to do so. (b) The officers working in the Prisons Department are accorded a fair hearing that is not prejudicial to their record in the service. The Departmental Disciplinary Board is properly constituted and the officers are accorded the chance not only to defend themselves and produce their defence witnesses, but also to cross-examine the prosecution witnesses. They are further informed of their right of appeal. The ex-warder, Mr. Joseph Gichuhi Mbogo, appealed to the Public Service Commission and his appeal was dismissed. He was advised to lodge a second appeal within the stipulated six months, which he failed to do so and was consequently time barred. The ex-warder subsequently stands dismissed as he was a liability to the department and prejudicial to the security of the prisons, due to habitual trafficking of contrabands with the prisoners."
